FDA Oversees Destruction And Recall Of Kratom Products; And Reiterates Risks Associated With This Opioid

SILVER SPRING, Maryland — The U.S. Food and Drug Administration today announced the voluntary destruction and recall of a large volume of kratom-containing dietary supplements manufactured and distributed nationwide under the brand names Botany Bay, Enhance Your Life and Divinity by Divinity Products Distribution of Grain Valley, Missouri. In cooperation with the FDA, the company has also agreed to stop selling all products containing kratom. Based on the scientific evidence of the serious risks associated with the use of kratom, in the interest of public health, the FDA encourages all companies currently involved in the sale of products containing kratom intended for human consumption to take similar steps to take their products off the market and submit any necessary evidence, as appropriate, to the FDA to evaluate them based on the applicable regulatory pathway.

Scientist Victor DeNoble To Talk About Tobacco Industry's Suppression Of Addiction Research

SACRAMENTO, California — While working as a postdoctoral fellow doing addiction research in 1980, a young scientist was recruited by the research arm of tobacco company Philip Morris USA to build a secret lab and develop a cigarette that would eliminate or reduce cardiovascular risk in smokers. Reportedly, the scientists at Philip Morris had invented the molecules but had no way to test them. This is where the new recruit, Victor DeNoble, PhD, came in — at that time one of a handful of scientists in the world with experience in an emerging field that involved complicated animal surgery.

TMD Treatment Focus Of 2017 Stanford Award-Winning Project

BIRMINGHAM, Alabama — A dental student who researched a surgical treatment option for patients with end-stage temporomandibular disease has been named the 2017 honoree for the John W. Stanford New Investigator Award.

The American Dental Association (ADA) Council on Scientific Affairs selected Cassandra Winterrowd, who is slated to graduate this year from the University of Alabama Birmingham School of Dentistry. She is on a team that investigated the osseous integration of titanium fixation screws that stabilize a temporomandibular joint prosthesis.

"A large percentage of the population suffers from temporomandibular dysfunction and patients afflicted with severe, end-stage TMD deserve reliable surgical options," said Ms. Winterrowd, who said her involvement in the research included literature review and collection of quantitative data from specimens (swine) part of prior in vivo experiments.

FDA Bans Active Ingredients From Nonprescription Antiseptic Products

SILVER SPRING, Maryland — In a final rule issued by the Food and Drug Administration (FDA), 24 active ingredients used in nonprescription antiseptic products are "not generally recognized as safe and effective" (GRAS/GRAE) for use by health care professionals in health care settings or situations "due to insufficient data." The rule mdash or the ban on use of these ingredients in over-the-counter antiseptics mdash finalizes the 2015 Health Care Antiseptic Proposed Rule and takes effect December 20, 2018.

Benevis, Kool Smiles To Pay $23.9 Million In Settlement With Department Of Justice

WASHINGTON, District of Columbia — Dental management company Benevis and more than 130 of its affiliated Kool Smiles clinics will pay $23.9 million, plus interest, to resolve allegations from the U.S. Department of Justice that they knowingly submitted false claims for payment to state Medicaid programs for medically unnecessary dental services performed on children insured by Medicaid, according to a DOJ news release.

EPA Issues Final Rule: Amalgam Separators Required

WASHINGTON, District of Columbia — The administrator for the Environmental Protection Agency has signed off on a final rule under the Clean Water Act to control the discharge of mercury and other metals entering the waste stream from dental practices. The rule will regulate dental practices that place or remove amalgam — it is not intended to apply to dental practices such as orthodontic and periodontal practices except in limited emergency circumstances. The effective date of the rule is 30 days after the rule is published in the Federal Register. The compliance date for most dentists will likely be January 2020, three years after the effective date.

WASHINGTON, District of Columbia — The Internal Revenue Service moved the annual deadline for filing copies of employees' Form W-2, W-3 and certain forms reporting nonemployee payments to independent contractors (such as Form 1099-MISC) with the Social Security Administration. The new deadline of January 31 was established by the Protecting Americans from Tax Hikes (PATH) Act to make it easier for the IRS to legitimize tax returns and spot errors based on the earned income tax credit and the refundable portion of the child tax credit in order to reduce fraud and improper payments.

California Proposition 65 Notice Requirements Revised

SACRAMENTO, California — The California EPA's Office of Environmental Health Hazard Assessment has adopted a regulation revising the notices that dental practices are required to post under Proposition 65, known as the Safe Drinking Water and Toxic Enforcement Act. The regulation, which takes effect in 2018, also amends the methods by which dental practices provide the notices.

California Dentists Must Claim 'Meaningful Use' Funds By December 31

SACRAMENTO, California — Under the provisions of the American Recovery and Reinvestment Act, participating Denti-Cal providers may receive up to $63,750 in incentive payments for implementing an electronic health record system and eventually achieving "meaningful use." These incentives, which are paid by the state of California, are limited to dentists whose practice is at least 30 percent Denti-Cal by patient volume.

California's Local Dental Pilot Project Application Deadline Nears

SACRAMENTO, California — The deadline to apply for Local Dental Pilot Project funding under Domain 4 of the Dental Transformation Initiative has been extended to September 30, 2016 as a result of a delay in the development of a budget template for the application. The California Department of Health Care Services opened its application cycle for LDPP proposals developed under the Medi-Cal 2020 Waiver June 1. Fifteen pilot projects will be selected to commence in January 2017.

CHICAGO, Illinois — The American Dental Association Foundation (ADAF) is now accepting applications for its Semi-annual Grants Program: Access to Care, which supports nonprofit organizations whose charitable activities provide access to care and dental homes to the underserved. HHS Initiates HIPAA Audits

WASHINGTON, District of Columbia — Dental practices should not ignore any email from the U.S. Department of Health and Human Services (HHS) Office for Civil Rights (OCR) as the agency announced that it has started the next phase of audits of HIPAA covered entities and business associates. The emails have been sent to verify contact information. If an entity does not respond to OCR's request to verify its contact information or to complete a pre-audit questionnaire, the entity may still be selected for an audit or subject to a compliance review. Additionally, OCR expects entities to check junk or spam email folder for emails from OCR.

NEW YORK, New York — The number of English- and Spanish-speaking parents who say their children brush for two minutes, twice a day has increased since the launch of the Kids' Healthy Mouths campaign in 2012. According to a recent report from the Ad Council and the Partnership for Healthy Mouths, Healthy Lives, there has been a 13 percent increase — from 48 percent in 2012 to 61 percent in 2015 — in English-speaking parents who report their child brushes twice a day, and a 4 percent increase in reporting their child brushes two minutes each time.

EPA Rule: Dentists Must Cut Amalgam Discharge

WASHINGTON, District of Columbia — The U.S. Environmental Protection Agency (EPA) has released new proposed standards to cut discharges of dental amalgam to the environment under the Clean Water Act. The proposed rule would require all affected dentists to control mercury discharges to Publicly Owned Treatment Works (POTWs). Specifically, it would require them to cut their dental amalgam discharges to a level using amalgam separators and the use of other "Best Management Practices," according to an EPA statement.

Legal Action Against Delta Awaits Decision On Arbitrator

SAN FRANCISCO, California — The California Dental Association's legal action against Delta remains in the preliminary stages, with the parties awaiting appointment of an arbitrator. Delta has requested appointment of a three-arbitrator panel, which delayed the appointment process while the parties attempted to resolve the issue. On December 9, CDA and six individual dentists filed an Amended Demand for Arbitration. Delta is expected to respond to that this week and include its reasoning on why three arbitrators rather than one should be appointed. Afterwards, a decision will be made on how the arbitration will proceed.

New Prescription Forms: A Reminder

ALBANY, New York – As of April 19, 2006 the Public Health Law required that all prescriptions written in New York State be issued on an official New York State prescription form. The Department of Health has begun limiting the amount ordered to 20 pads (2000 RX) per month. Dentists who have not yet registered for the forms, must do soimmediately. FDA Issues Public Health Advisory Regarding Benzocaine Sprays

WASHINGTON, District of Columbia – Benzocaine sprays are used in medical practice for locally numbing mucous membranes of the mouth and throat for minor surgical procedures or when a tube must be inserted into the stomach or airways. Their use is known to be occasionally associated with methemoglobinemia. However, cases of methemoglobinemia have also resulted from medication errors due to incorrect use of benzocaine sprays (e.g., longer duration or more frequent sprays than recommended.).

FDA Provides Information on Investigation into Human Tissue for Transplantation

WASHINGTON, District of Columbia – The Food and Drug Administration (FDA) is notifying the public of its investigation of human tissue recovered by Biomedical Tissue Services, Ltd. (BTS) of Ft. Lee, NJ, and sent to tissue processors. Some of this tissue may have been implanted into patients from early 2004 to September 2005. The tissue was recovered by BTS from human donors who may not have met FDA donor eligibility requirements and who may not have been properly screened for certain infectious diseases. At this time, the implicated tissues from BTS include human bone, skin, and tendons. These products represent only a small percentage of the overall U.S. tissue supply.
